Terms of Service

Khomkai is an AI-powered Thai home-cooking education service offering chat-based recipe assistance, AI-generated image plating cards and AI-generated wok-side video reels. Features may change as we improve the product.

For payment-processor classification, Khomkai is a digital-goods subscription (MCC 5817 / 5818 — Digital Goods, Books, Movies & Music / Digital Goods: Applications). Khomkai is not a restaurant, food-delivery service, catering service, grocery, nutritional supplement vendor, weight-loss programme, telehealth service, dietitian or medical advice provider.

All outputs are educational and entertainment-oriented. Khomkai does not sell food, ingredients, kitchenware, alcohol, tobacco, CBD, supplements, or any physical goods.

You must be at least 13 years old to use the service. Users aged 13–17 must have a parent or legal guardian's consent.

You are responsible for the security of your account credentials and for all activity that occurs under your account.

One account per person. No account sharing, reselling or transfer.

Cooking involves heat, oil and sharp tools. An adult must be physically present at the stove for any user under 18.

Your use of the service is subject to our Acceptable Use Policy at khomkaithaicuisine.com/acceptable-use. Violations may result in warning, content removal, suspension or termination without refund.

Subscriptions renew automatically until you cancel from the billing portal.

Monthly dish, reel and plating-card allowances reset on the first of each calendar month and do not roll over.

Khomkai does not sell separate credit packs. Allowances are service-usage units only, not currency, not transferable and not refundable once consumed.

Payments are processed by our certified payment processors (currently Stripe, PayPal and Creem). By subscribing you authorise recurring charges in the amount and at the frequency shown at checkout until you cancel. The processor used for your subscription is shown on the checkout page and on every receipt; switching processors does not change your subscription terms.

Prices are shown in USD and exclude any local taxes which may be added at checkout.

We will send a reminder before yearly subscriptions renew.

We own the Khomkai service, its branding and underlying technology.

You retain ownership of content you upload. You own AI outputs generated for you, subject to the Acceptable Use Policy and the rights of any third party depicted in your inputs.

You grant us the limited licence described in the Content License at khomkaithaicuisine.com/content-license.

You may cancel at any time from the billing portal. Cancellation takes effect at the end of the current billing period.

We may suspend or terminate accounts that violate these Terms, including for safety, legal, security or fraud reasons. We will refund any unused, unconsumed pre-paid allowances on a pro-rata basis when termination is for our convenience.

The service is provided "as is" and "as available".

To the maximum extent permitted by law, KHOMKAI THAI CUISINE LTD is not liable for indirect, incidental, special, consequential or punitive damages. Our aggregate liability for any claim arising out of the service is limited to the amount you paid us in the twelve months preceding the claim, or USD 100, whichever is greater.

Nothing in these Terms excludes liability for fraud, death or personal injury caused by our negligence, or any other liability that cannot be excluded under applicable law.

These Terms are governed by the laws of England and Wales. The courts of England and Wales have non-exclusive jurisdiction. If you are a consumer outside the UK, you may also rely on mandatory consumer-law rights of your country of residence.
